The Party experiencing Force Majeure shall notify the other Party immediately in writing.

-
5.2. Persons under the age of 18 (eighteen) cannot shop from WEXYS STORE. The Seller shall assume that the age specified by the Buyer in the Agreement is accurate. However, no liability shall be attributed to the Seller due to the Buyer stating their age incorrectly.
-
5.3. https://{{SabitTanimlar.site_url}} is not responsible for price errors caused by system glitches. Accordingly, the Seller is not responsible for promotion or price errors that may arise due to system glitches, design errors, or illegal interventions on the website. The Buyer cannot claim any rights against the Seller based on system errors.
-
5.4. Purchases can be made on https://{{SabitTanimlar.site_url}} via credit card (Visa, MasterCard, etc.) or bank transfer. Orders for which transfer is not completed within one week from the order date shall be canceled. The processing time for orders is not the moment the order is placed, but the moment the required collection is made from the credit card account or the bank transfer (EFT) reaches the bank accounts. Payment methods such as cash on delivery or postal check carried out without consulting customer services are not accepted.
Article 6 - Rights and Obligations of the Buyer
-
6.1. The Buyer agrees and undertakes to fulfill the obligations assigned to them under the Agreement fully, except in cases of force majeure.

-
6.3. -
6.5. If the Buyer wishes to return the purchased product, they agree and undertake not to damage the product or its packaging under any circumstances, and to return the original invoice and delivery note at the time of return.
Article 7 - Order / Payment Procedure
Order:
Once the total amount in TL including VAT of the products added to the shopping cart (total installment amounts in installment transactions) is approved by the Buyer, it is processed through the POS of the relevant bank card. Therefore, an order confirmation email is sent to the customer before the orders are dispatched. Dispatches are not made without sending an order confirmation email.
Any disruption in the process or potential problems regarding credit cards are communicated to the Buyer using one or more of the contact channels (phone/fax/email) specified in the Agreement. If necessary, the Buyer may be requested to contact their bank. The processing time for orders is not the moment the order is placed, but the moment the required collection is made from the credit card account or the bank transfer (EFT) is determined to have reached the Seller's accounts.
Exceptionally, if it is understood that the product subject to the Agreement cannot be supplied for a justified reason and/or a stock issue is encountered, the Buyer shall be informed immediately in a clear and understandable manner. Upon the Buyer's approval, another product of equal quality and price may be sent, or in accordance with the Buyer's wish and choice: a new different product may be sent, waiting for the product to enter stock or for the hindrance to delivery to be resolved, and/or the order may be canceled.
In cases where fulfilling the delivery obligation of the product subject to the Agreement becomes impossible, the Buyer shall be notified of this situation, and the total price paid together with any document placing them under obligation shall be returned within ten days at the latest, and the Agreement shall be canceled. In such a case, the Buyer shall have no additional material or moral damage claims from the Seller.
Payment:
In cases where, after delivery of the product, the Buyer's credit card is used unfairly or unlawfully by unauthorized persons through no fault of the Buyer, and the relevant bank or financial institution fails to pay the product price to the Seller, the Buyer is obliged to return the delivered product to the Seller within 10 days. In such cases, shipping costs belong to the Buyer.
If the Buyer chooses to pay by credit card, the BUYER accepts, declares, and undertakes that they will confirm the relevant interest rates and default interest information separately from their bank, and that the provisions regarding interest and default interest shall be applied within the scope of the "Credit Card Agreement" between the Bank and the BUYER pursuant to the applicable legislation.
Article 8 - Dispatch / Delivery Procedure
Dispatch:
Upon sending the order confirmation email, the product(s) are handed over to the cargo/courier company contracted by the Seller.
Delivery:
The product(s) will be delivered to the Buyer's address by the Seller's contracted courier. The delivery period is 30 days from the sending of the order confirmation email and the establishment of the Agreement. Provided that the Buyer is notified in advance in writing or via a durable data medium, this period may be extended by a maximum of ten days.
Products are sent with phone notification to regions where courier companies do not perform address delivery.
In regions where the courier company delivers once a week, or in cases of errors and omissions in shipping information, certain social events, and natural disasters, delays may occur beyond the specified timeframe. The Buyer cannot hold the Seller liable for such delays. If the product is to be delivered to a person/organization other than the Buyer, the Seller is not responsible for extra shipping costs arising from the recipient's refusal of delivery, errors in shipping information, and/or the Buyer not being present at the address. If the product(s) have not reached the customer within the specified days, delivery issues must be reported immediately to Customer Services via the email address {{SabitTanimlar.firmaemail}}.
In case of damaged packages: Damaged packages should not be received, and a damage report must be filed with the courier representative. If the courier representative believes the package is not damaged, the Buyer has the right to open the package on site, verify that the products were delivered undamaged, and request that the condition be determined via a report. Once the package is accepted by the Buyer, the courier company is deemed to have fully performed its duty. If the package was rejected and a report was drawn up, the situation must be reported to the Seller's Customer Services as soon as possible together with the copy of the report retained by the Buyer.
Article 9 - Product Return and Right of Withdrawal Procedure
Product Return:
The Buyer has the right to withdraw from the contract within seven days after receiving the goods without giving any reason and without paying any penalty. Pursuant to General Communiqué No. 385 of the Tax Procedural Law, for return procedures to be processed, the Buyer must complete and sign the return sections at the bottom of the 2 invoice copies delivered with the product, send one copy to the Seller along with the product, and retain the other copy. The withdrawal period begins on the day the goods are delivered to the Buyer. The return shipping cost of returned product(s) must be covered by the Buyer.
There is no right of withdrawal for goods prepared in line with the Buyer's requests and/or explicitly personal needs.
If the Buyer exercises their right of withdrawal, the Seller shall refund the total amount received and any document placing the consumer under obligation within ten days at the latest from the date the invoice containing the withdrawal notification reaches the Seller along with the product, at no cost to the consumer.
A decrease in the value of the delivered goods or the existence of a reason making return impossible does not prevent the exercise of the right of withdrawal. However, if the decrease in value or impossibility of return is due to the consumer's fault, the consumer must compensate the Seller for the value or reduction in value of the goods.
The general return period for accidentally purchased products is also 7 days. Within this period, returns of products whose packaging has been opened, used, destroyed, or otherwise damaged are not accepted. Returns must be made with the original packaging.
In cases where any opening, impairment, breakage, destruction, tearing, usage, or other conditions are detected in the accidentally purchased product and its packaging, or if the product cannot be returned in the state it was delivered to the Buyer, the product shall not be accepted for return and no refund shall be made.
For product returns, the situation must first be communicated to customer service. Return shipping instructions will be provided to the customer by the Seller. Following this communication, the Buyer must send the product together with the invoice containing return details to the Seller via the courier company that performed the initial delivery. If the returned product reaching the Seller fulfills the conditions specified in this Agreement, it shall be accepted as a return, and the refund shall be made to the Buyer's credit card/account. No refund shall be made before the product is returned. The reflection time of refunds made to credit cards onto credit card accounts is at the discretion of the relevant bank.
If the purchase was made by credit card in installments, the credit card refund procedure will be applied as follows: The Bank reimburses the Buyer in installments according to the number of installments requested when purchasing the product. After the Seller pays the total product price to the bank at once, in order to prevent parties involved in the transaction from being victimized in installment refunds made through Bank POS machines, the requested refund amounts are transferred by the Bank to the cardholder accounts in installments. The installment amounts paid by the Buyer prior to sale cancellation will be reflected to the card as 1 (one) refund per month if the return date does not coincide with the card's statement cut-off date, and the Buyer will receive the installments paid prior to the return for as many months as the number of installments paid prior to return after the original installments end, deducting them from existing debts.
In the event of a return of goods and services purchased by card, the Seller cannot pay the Buyer in cash pursuant to the contract made with the Bank. When a return transaction is in question, the merchant (Seller) will execute the refund via the relevant software, and since the merchant is obligated to pay the relevant amount to the Bank in cash or on account, cash payment cannot be made to the Buyer under the detailed procedure outlined above. Credit card refunds will be executed by the Bank under the procedure above after the Seller pays the amount to the Bank in a single lump sum.
Article 10 - Warranty
Products used and cleaned in accordance with the operating instructions are warranted against all manufacturing defects for 2 years under the terms below: The Seller's warranty liability applies solely to consumers within the scope of Law No. 4077. For commercial transactions, the provisions of the Turkish Commercial Code shall apply.
Article 11 - Confidentiality
Information specified by the Buyer in this Agreement and information provided to the Seller for payment purposes shall not be shared with 3rd parties by the Seller. The Seller may only disclose this information within the framework of administrative/legal necessity. Within any judicial investigation with documented investigative authority, the Seller may provide the requested information to the relevant authority if it possesses it.
Credit Card details are strictly not stored. Credit Card details are used only to obtain authorization by being securely transmitted to the relevant banks during collection and are deleted from the system post-authorization. Information belonging to the Buyer, such as email address, postal address, and telephone, is used by the Seller solely for standard product delivery and notification procedures. Campaign information, details on new products, and promotional info may be sent to the Buyer during certain periods following their consent.
Article 12 - Authorized Court and Execution Offices in Case of Dispute
In case of disputes arising from the implementation of this Agreement, Consumer Arbitration Committees up to the value announced every December by the Ministry of Industry and Trade, and Consumer Courts located in the settlement area of the Buyer or Seller, are authorized.
In the event that the order is placed, the Buyer is deemed to have accepted all terms of this Agreement.
